These Terms and Conditions ("Terms") govern your use of the delivery, pickup and messenger services provided by MG Messenging ("MG Messenging", "we", "us"), including our website and our text message (SMS/MMS) and email notifications. By using our services or opting in to our messages, you agree to these Terms.

1. Our services

MG Messenging provides local delivery, pickup and messenger services. Delivery times and ETAs are estimates and are not guaranteed. We are not responsible for delays caused by traffic, weather, incorrect addresses, recipient unavailability or other events outside our control.

2. SMS / text message program

Program name: MG Messenging Delivery Notifications

Program description: When you or the business sending your package provide your mobile number and agree to receive notifications, MG Messenging sends transactional text messages about your deliveries and pickups. These include confirmations that a package was delivered or picked up, the number of packages, where the package was left, the delivery address, a photo of the delivery, the name of the person who signed (if a signature was collected), and notices if a delivery could not be completed.

How to opt in: You can sign up to receive delivery notifications by text message by calling MG Messenging at (917) 363-0677 and asking to receive delivery text notifications, or by emailing mgmessenging@gmail.com with your mobile number and a request to receive delivery text notifications. Our staff asks you to confirm that you agree to receive text messages and records your number and consent before any messages are sent. Details: mgmessenging.com/sms. By opting in, you agree to receive transactional delivery and pickup text messages from MG Messenging at the number you provided.

Message frequency: Message frequency varies based on your delivery and pickup activity, typically one or two messages per delivery or pickup.

Cost: Message and data rates may apply. MG Messenging does not charge for these messages, but your mobile carrier's standard rates apply.

Opt out: You can cancel the SMS service at any time. Just text STOP to the number that messages you. After you send STOP, we will send one final message confirming that you have been unsubscribed, and you will no longer receive SMS messages from us. To join again, text START or UNSTOP.

Help: If you are having trouble with the messaging program, text HELP for assistance, or contact us using the contact details below.

Carrier liability: Carriers are not liable for delayed or undelivered messages.

No marketing: These messages are for delivery and pickup notifications only. We do not send marketing or promotional text messages through this program.

Consent to receive text messages is not a condition of any purchase or service. Your mobile number and SMS consent will not be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for details.

3. Email notifications

We may send email confirmations for deliveries and pickups, which may include photos, signatures and delivery details. You can ask to stop receiving email notifications at any time by contacting us.

4. Proof of delivery

Our drivers may take a photo of the delivered or picked-up items and, where required, collect a signature and the name of the person signing. This information is used as proof of delivery and is shared with the sender and/or recipient of the shipment. Photos are kept for a limited period and then automatically deleted.

5. Your responsibilities

Provide accurate delivery addresses, contact names and phone numbers.
Only provide a mobile number that you own or are authorized to use, and only with the consent of the person who will receive the messages.
Do not ship items that are illegal, hazardous or otherwise prohibited.

6. Limitation of liability

To the fullest extent permitted by law, MG Messenging is not liable for indirect, incidental, special or consequential damages arising from the use of our services or messages. Our total liability for any claim related to a shipment is limited to the amount paid for that delivery or pickup, unless otherwise agreed in writing.

7. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Continued use of our services after changes means you accept the updated Terms.

8. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules.
